  • Resell or use the Site(s) or its contents for any commercial purposes;
  • Collect and use any product listings, descriptions, or prices found on the Site(s);
  • Make any derivative use of the Site(s) or its contents;
  • Download or copy account information found on the Site(s) for the benefit of any individual or corporation;

  • Use any metatags or any other “hidden text” using NASP’s name or trademarks without NASP’s express written consent. Any unauthorized use immediately terminates the limited license granted to you by NASP;
  • Create a hyperlink to the home page or any other page of the Site(s) or use any of NASP’s logos or any other proprietary graphic or trademark of NASP without NASP’s express written permission.

NASP grants to commercial web search engines a limited license to index the Site(s) by any manual or automated method and to display the titles of pages and brief excerpts from those pages as search results.

  1. Trademarks

The trademarks, logos, service marks, graphics, and trade dress displayed on the Site(s) are the intellectual property of NASP and other applicable parties that have licensed their property and/or material to NASP. You should assume that any product or service name is a registered mark, trademark, or service mark and the intellectual property of NASP or a third party. You are prohibited from using any NASP or third-party trademarks or service marks noted on the Site(s) for any purpose, including but not limited to use as metatags on other pages or websites on the World Wide Web, without the express written permission of NASP or such third parties.   1. Changes to Conditions of Use

NASP reserves the right to revise these Conditions of Use at any time. When changes are made to the Conditions of Use, a revised agreement containing a new “Last Updated” date will be posted on the Site(s).  It is your responsibility to periodically review NASP’s Conditions of Use when visiting the Site(s).

  1. Severability

If any condition in this Agreement is deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining conditions.

  1. Violations of Conditions of Use

NASP reserves the right to seek all remedies available at law and in equity for violations of these Conditions of Use, including the right to block access to the Site(s).

  1. Access to Password-Secure Areas

NASP may restrict certain secure areas of the Site(s) to authorized users and permit access to these secure areas only by the use of a confidential password. Unauthorized individuals attempting to access such areas of the Site(s) are in explicit violation of these Conditions of Use and may be subject to prosecution and applicable damages.

  1. Copyright- Secure Areas

The contents and information provided in the NASP Programs as well as the Site(s) are the copyrighted property of NASP and are registered with the U.S. Patent and Trademark Office.

Each ID and Password generated for any of the NASP Programs is for one-time use only, meaning that one ID and Password is used by one Program participant, and is to be retained by that Program participant upon completion of the Program.  You may not administer or utilize either the Home-Study Kit or the Online version of the NASP Programs in a group setting.

  1. Jurisdictional Issues and Applicable Law

You acknowledge and agree that the Site(s) are controlled and operated from the United States and are not intended to subject NASP to any non-US jurisdiction or law.  You also acknowledge and agree that these Conditions of Use, your use of the Site(s), and any dispute of any kind that might arise between you and NASP in connection with the Site(s) shall be governed by the laws of the State of New York and applicable federal law, without regard to conflict of law principles.  Any action brought by you, any third party, or NASP pursuant to or in connection with your use of the Site(s) and/or these Conditions of Use, shall be brought exclusively in the state courts of, or federal courts in the State of New York, and you agree to submit to the personal jurisdiction of, and waive any objection to, venue of such courts.
